These Terms of Service ("Terms") govern your access to and use of AirQr (the "Service"), operated by Enginii LLC ("we," "us," or "our"). By accessing or using the Service at https://airqr.app, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Description of Service

AirQr is a free, browser-based QR code generator that allows you to create, customize, and download QR codes. The Service runs entirely in your browser — your content is processed locally on your device and is not transmitted to or stored on our servers.

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

2. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Your Use of the Service

You may use the Service for any lawful purpose, subject to these Terms. You are solely responsible for the content you encode into QR codes using the Service and for any consequences that arise from that content. We do not monitor, review, or endorse the content of QR codes generated through the Service.

You agree to use the Service in compliance with all applicable local, state, national, and international laws and regulations.

4. Prohibited Activities

You agree not to use the Service for any of the following purposes:

Illegal Content

Generating QR codes that link to illegal material, malware, phishing sites, or content that violates any applicable law.

Spam and Bulk Abuse

Using the Service to mass-generate QR codes for spam campaigns, unsolicited marketing, or any form of bulk distribution intended to harass or deceive recipients.

Automated Access

Accessing the Service through scraping, bot traffic, automated scripts, or any programmatic means at scale without our prior written permission. This includes using the Service as a backend for another application or service without authorization.

Malicious Use

Generating QR codes designed to deceive, defraud, or harm end users who scan them — including but not limited to fake payment pages, fake login pages, social engineering attacks, or any scheme intended to obtain personal information, credentials, or funds through deception.

Impersonation

Generating QR codes that impersonate other brands, companies, individuals, or government entities, or that falsely suggest affiliation with, endorsement by, or sponsorship of any third party.

Intellectual Property Violations

Encoding content that infringes on copyrights, trademarks, trade secrets, or other intellectual property rights of any third party.

Circumventing Technical Measures

Deliberately working around, bypassing, or attempting to defeat any technical measures we implement, including but not limited to rate limiting, bot protection, access controls, or any other security or usage restrictions.

We reserve the right to take any action we deem appropriate in response to violations of these prohibitions, including blocking access to the Service, reporting conduct to law enforcement authorities, or pursuing legal remedies.

5. Intellectual Property

The Service, including its design, interface, code, graphics, logos, and documentation, is owned by Enginii LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code of the Service, unless applicable law permits it or you have our written permission.

The AirQr name and logo are trademarks of Enginii LLC. You may not use them without our prior written consent.

6. User-Generated Content

QR codes you generate using the Service are yours. We do not claim ownership over the content you encode or the QR codes you create. Because the Service operates entirely in your browser, we do not have access to, store, or retain the content of your QR codes.

You are solely responsible for ensuring that the content you encode does not violate these Terms, any applicable law, or the rights of any third party.

7. Third-Party Services

The Service may contain links to or integrate with third-party services, including analytics providers and advertising networks. These third-party services are governed by their own terms and privacy policies. We are not responsible for the content, practices, or policies of any third-party services and encourage you to review their terms before interacting with them.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that QR codes generated by the Service will be scannable by all devices or applications, or that they will function correctly in all circumstances.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ENGINII LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Enginii LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt and expenses (including attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; or (d) the content you encode into QR codes using the Service.

11. Termination

We may restrict or terminate your access to the Service at any time, for any reason, without notice or liability. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date at the top of this page. If we make material changes, we may notify you by prominently posting a notice on the Service. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
